1. Agreement to Terms

By accessing our website, purchasing materials, scheduling a delivery, or utilizing our dumping services, you ("the Customer") agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our services.

2. Scope of Products and Services

Reliable Soil and Stone offers bulk materials and professional land services, including:

  • Materials: Bulk stone, mulch, fill dirt, topsoil, and construction aggregates.

  • Services: Delivery, dumping site access, site preparation, land clearing, grading, pond excavation, and demolition.

3. Material Disclaimer

  • Natural Variation: All materials are natural products sold in bulk. We do not guarantee exact matches regarding color, moisture content, particle size, or texture.

  • Reference Only: Photos on our website or marketing materials serve as general representations and may differ from the actual delivered load.

  • Acceptance: Materials are considered accepted once they leave our facility or are successfully delivered to the Customer’s location.

4. Delivery Policies

  • Site Access: The Customer is responsible for providing a clear, safe, and accessible area for delivery. Our drivers reserve the right to refuse delivery if site conditions are deemed unsafe.

  • Property Liability: Reliable Soil and Stone and its drivers are not liable for damage to driveways, sidewalks, lawns, structures, or underground utilities resulting from delivery operations.

  • Placement: The Customer must confirm the dump location before the material is unloaded. Once dumped, materials will not be moved or reloaded.

  • Scheduling: All delivery times provided are estimates and are not guaranteed.

5. Dumping Services

  • Prior Approval: All materials brought to our site for dumping must be approved by staff prior to unloading.

  • Prohibited Items: We strictly prohibit hazardous, contaminated, or otherwise unauthorized materials.

  • Inspection & Liability: We reserve the right to inspect any load. The Customer assumes all liability for improper disposal or the dumping of prohibited materials.

6. Payment and Pricing

  • Due Date: Payment is required at the time of purchase unless a written agreement for a business account is in place.

  • Accepted Methods: We accept cash, major credit/debit cards, and approved business accounts.

  • Fees & Changes: Returned checks or declined payments will incur additional processing fees. Prices for all products and services are subject to change without prior notice.

7. Returns and Refunds

  • Final Sales: Due to the nature of bulk products, all sales are final once the material is picked up or delivered.

  • No Returns: We cannot accept returns on materials that have already been dumped or delivered.

  • Claims: Any claims regarding material quality or quantity must be made immediately at the time of pickup or delivery.

8. Site Work and Service Liability

For all land services (clearing, grading, excavation, etc.):

  • Utility Locating: The Customer is responsible for ensuring all underground utilities are marked. You must contact your local utility locating service prior to the start of work.

  • Liability: Reliable Soil and Stone is not responsible for damage to any unmarked or improperly marked utilities.

  • Weather: Scheduling for site work is subject to change based on weather conditions.

9. Limitation of Liability

The total liability of Reliable Soil and Stone for any claim is strictly limited to the purchase price of the specific materials or services provided. We shall not be held liable for:

  • Project delays or indirect/consequential damages.

  • Property damage occurring during standard delivery operations.

  • The improper use or installation of materials by the Customer or third parties.

10. Intellectual Property and Website Use

All website content—including text, logos, branding, and images—is the exclusive property of Reliable Soil and Stone. Unauthorized copying or use of this content without express written permission is prohibited.

11. Governing Law

These Terms and Conditions are governed by the laws of the State of Ohio. Any legal disputes shall be resolved within the jurisdiction of Ottawa County, Ohio.
